License Agreement

Read about your rights and restrictions when using our proprietary ePOS software and systems.

Introduction

This License Agreement ("Agreement") is a legal contract between you ("Licensee," "User," or "you") and ePos Daddy ("Licensor," "we," "our," or "us") governing your use of our cloud-based ePOS software, services, websites, and any associated documentation ("Software"). By accessing or using the Software, you agree to be bound by the terms of this Agreement. If you do not agree, do not install, access, or use the Software.

This Agreement outlines the scope of the license granted, user obligations, restrictions, and legal protections for both parties.

Grant of License

ePos Daddy grants you a non-exclusive, non-transferable, revocable, limited license to use the Software solely for your internal business operations, subject to the terms of this Agreement and any applicable subscription plan.

This license includes access to:

Our web-based and mobile ePOS applications
Associated APIs and integrations
Technical documentation and user guides

Restrictions

You may NOT:

Reproduce, distribute, or publicly display the Software
Modify, adapt, translate, or create derivative works
Decompile, reverse engineer, or attempt to access source code
Sell, rent, lease, sublicense, or assign rights to third parties
Use the Software in any way that violates laws or third-party rights

Any unauthorized use will result in immediate termination of this license.

Ownership and Intellectual Property

All title, ownership rights, and intellectual property rights in and to the Software, content, and related materials are owned by ePos Daddy and its licensors. The source code and code base of the Software were developed by syhtek software solutions and remain their sole intellectual property. Nothing in this Agreement shall be interpreted as transferring any such rights to the User.

Keyboard-navigable interfaces for all interactive components
Screen reader compatibility and ARIA (Accessible Rich Internet Applications) labels
Sufficient color contrast ratios for text and background
Alternative text for images and non-decorative elements
Scalable fonts and resizable interfaces

The ePos Daddy name, logo, and associated branding are protected by trademark laws. Unauthorized use is strictly prohibited.

Software Updates

ePos Daddy may provide updates, patches, and new features. These updates may be installed automatically or require manual action. Your continued use constitutes agreement to receive and install updates as part of the license.

Some updates may introduce changes to functionality or user interface. While we aim to improve user experience, we cannot guarantee backward compatibility in all instances.

Term and Termination

This license is effective from the moment you access the Software and remains in force until terminated. Termination can occur:

By you, by ceasing to use the Software
By us, if you breach any terms of this Agreement
Automatically, upon expiration or non-renewal of a subscription

Upon termination:

All rights granted under this license cease
You must delete all copies of the Software in your possession
We reserve the right to restrict or delete your account data as per our retention policy

User Responsibilities

As a Licensee, you are responsible for:

Ensuring your use complies with local laws and industry standards
Protecting your login credentials and preventing unauthorized access
Maintaining the security of your hardware and network environment
Notifying us of any breaches or security concerns

Support and Maintenance

Support is provided as outlined in your subscription plan. Typical support channels include:

Email and ticketing system
Live chat
Onboarding sessions
Help center and documentation

We aim to respond to standard inquiries within 1–2 business days. Priority support may be available for premium plans.

Data Use and Privacy

Use of the Software is also governed by our Privacy Policy. You agree that we may collect and use technical data and related information—including usage patterns, device types, and system configuration—to facilitate product improvements and support services.

We do not claim ownership over your data but may access it for troubleshooting, analytics, and legal compliance purposes.

Limitation of Liability

To the maximum extent permitted by law, ePos Daddy shall not be liable for:

Indirect, incidental, or consequential damages
Data loss, business interruption, or reputational harm
Any claim exceeding the total subscription fees paid by you in the preceding 12 months
Some jurisdictions do not allow limitation of liability, so these provisions may not apply in full.

No Warranties

The Software is provided "as-is" and "as-available." We disclaim all warranties, express or implied, including:

Fitness for a particular purpose
Non-infringement
Continuous availability or error-free operation

We do not warrant that the Software will meet your requirements or that it will be free from bugs or vulnerabilities.

Indemnification

You agree to indemnify, defend, and hold harmless ePos Daddy and its affiliates, employees, and agents from any claims, damages, liabilities, or costs arising from:

Your use or misuse of the Software
Violation of this Agreement
Infringement of third-party rights

Export Compliance

You may not use or access the Software if you are located in a jurisdiction subject to sanctions or export restrictions. You agree to comply with all applicable export control laws and regulations.

Governing Law

This Agreement is governed by the laws of [Insert Jurisdiction], without regard to its conflict of law rules. Any disputes shall be resolved in the courts of [Insert Jurisdiction].

Entire Agreement

This Agreement, along with our Terms and Conditions and Privacy Policy, constitutes the entire understanding between the parties concerning the Software. It supersedes all prior or contemporaneous communications, whether oral or written.
